adopts, this tenth day of June of the year one thousand nine hundred and twenty-five, the following Draft Convention for ratification by the Members of the International Labour Organisation; in accordance with the provisions of Part XIII of the Treaty of Versailles and of the corresponding Parts of the other Treaties of Peace:

Artykuł 1.

Każdy Członek Międzynarodowej Organizacji Pracy, ratyfikujący niniejszą konwencję, zobowiązuje się do zapewnienia ofiarom wypadków przy pracy lub członkom ich rodziny warunków odszkodowania, co najmniej równych tym, które przewiduje niniejsza konwencja.

Tout Membre de l'Organisation internationale du Travail qui ratifie la présente Convention s'engage à assurer aux victimes d'accidents du travail, ou à leur ayants droit, des conditions de réparation au moins égales à celles prévues par la présente Convention.

Each Member of the International Labour Organisation which ratifies this Convention undertakes to ensure that workmen who suffer personal injury due to an industrial accident, or their dependants, shall be compensated on terms at least equal to those provided by this Convention.

Ustawy i rozporządzenia o odszkodowaniu za wypadki przy pracy winny stosować się do robotników, pracowników umysłowych lub uczniów zatrudnionych w przedsiębiorstwach, eksploatacjach i zakładach jakiegokolwiek bądź rodzaju, publicznych lub prywatnych.

Les législations et réglementations sur la réparation des accidents du travail devront s'appliquer aux ouvriers, employés ou apprentis occupés par les entreprises, exploitations ou établissements de quelque nature qu'ils soient, publics ou privés.

The laws and regulations as to workmen's compensation shall apply to workmen, employees and apprentices employed by any enterprise, undertaking or establishment of whatsoever nature, whether public or private.

Jednakże każdy Członek będzie mógł przewidzieć w swym ustawodawstwie krajowym takie wyjątki, jakie uzna za konieczne, o ile chodzi o:

Toutefois, il appartiendra à chaque Membre de prévoir dans sa législation nationale telles exceptions qu'il estimera nécessaires en ce qui concerne:

It shall nevertheless be open to any Member to make such exceptions in its national legislation as it deems necessary in respect of:

a) osoby, wykonywające prace dorywcze, nie związane z przedsiębiorstwem pracodawcy;

a) les personnes exécutant des travaux occasionnels étrangers à l'entreprise de l'employeur;

(a) persons whose employment is of a casual nature and who are employed otherwise than for the purpose of the employer's trade or business;

Nie są objęci niniejszą konwencją:

This Convention shall not apply to

a) marynarze i rybacy, co do których stanowić będzie późniejsza konwencja;

1) les marins et pêcheurs pour lesquels disposera une convention ultérieure;

(1) seamen and fishermen for whom provision shall be made by a later Convention;

Niniejsza konwencja nie będzie stosowała się do rolnictwa, co do którego pozostaje w mocy konwencja o odszkodowaniu za wypadki przy pracy w rolnictwie, przyjęta na trzeciej sesji Międzynarodowej Konferencji Pracy.

La présente Convention ne s'appliquera pas à l'agriculture pour laquelle reste en vigueur la Convention sur la réparation des accidents du travail dans l'agriculture, adoptée par la Conférence internationale du Travail à sa troisième session.

This Convention shall not apply to agriculture, in respect of which the Convention concerning workmen's compensation in agriculture adopted by the International Labour Conference at its Third Session remains in force.

Odszkodowanie należne w razie wypadków, które spowodowały śmierć lub stałą niezdolność do pracy, będzie wypłacane ofierze wypadku przy pracy lub członkom jej rodziny w postaci renty.

Les indemnités dues en cas d'accidents suivis de décès ou en cas d'accidents ayant entraîné une incapacité permanente seront payées à la victime ou à ses ayants droit sous forme de rente.

The compensation payable to the injured workman, or his dependants, where permanent incapacity or death results from the injury, shall be paid in the form of periodical payments; provided that it may be wholly or partially paid in a lump sum, if the competent authority is satisfied that it will be properly utilised.

Jednakże odszkodowanie to będzie mogło być wypłacane w całości lub w części w postaci wartości kapitałowej, jeżeli właściwym władzom będzie dana gwarancja należytego zużytkowania tej wartości kapitałowej.

Toutefois, ces indemnités pourront être payées en totalité ou en partie sous forme de capital lorsque la garantie d'un emploi judicieux sera fournie aux autorités compétentes.

W razie niezdolności do pracy odszkodowanie będzie przyznane najpóźniej od piątego dnia po wypadku, niezależnie od tego, czy udziela go pracodawca, czy instytucja ubezpieczenia od wypadków, czy też instytucja ubezpieczenia na wypadek choroby.

En cas d'incapacité, l'indemnité sera allouée au plus tard à partir du cinquième jour après l'accident, qu'elle soit due par l'employeur, par une institution d'assurance contre les, accidents, ou par une institution d'assurance contre la maladie.

In case of incapacity, compensation shall be paid not later than as from the fifth day after the accident, whether it be payable by the employer, the accident insurance institution, or the sickness insurance institution concerned.

Dodatkowe odszkodowanie będzie przyznane ofiarom wypadków przy pracy, które znajdują się w takim stanie niezdolności do pracy, że wymagają stałej opieki innej osoby.

Un supplément d'indemnisation sera alloué aux victimes d'accidents atteintes d'incapacité nécessitant l'assistance constante d'une autre personne.

In cases where the injury results in incapacity of such a nature that the injured workman must have the constant help of another person, additional compensation shall be provided.

Ustawodawstwa krajowe przewidywać będą środki kontroli oraz metody dla rewizji odszkodowań, jakie uznane będą za potrzebne.

Les législations nationales prévoieront les mesures de contrôle ainsi que les méthodes pour la revision des indemnités, qui seront jugées nécessaires.

The national laws or regulations shall prescribe such measures of supervision and methods of review as are deemed necessary.

Ofiary wypadków przy pracy będą miały prawo do pomocy leczniczej i do takiej pomocy chirurgicznej i farmaceutycznej, jaka będzie uznana za potrzebną na skutek tych wypadków. Koszty wymienionej pomocy leczniczej obciążać będą bądź pracodawcę, bądź instytucje ubezpieczenia od wypadków, bądź też instytucje ubezpieczenia na wypadek choroby albo inwalidztwa.

Les victimes d'accidents du travail auront droit à l'assistance médicale et à telle assistance chirurgicale et pharmaceutique qui serait reconnue nécessaire par suite de ces accidents. Cette assistance médicale sera à la charge soit de l'employeur, soit des institutions d'assurance contre les accidents, soit des institutions d'assurance contre la maladie ou l'invalidité.

Injured workmen shall be entitled to medical aid and to such surgical and pharmaceutical aid as is recognised to be necessary in consequence of accidents. The cost of such aid shall be defrayed either by the employer, by accident insurance institutions, or by sickness or invalidity insurance institutions.

Ofiary wypadków przy pracy będą miały prawo do otrzymania od pracodawcy lub instytucji ubezpieczeniowej oraz do normalnego odnawiania przez nich protez i aparatów ortopedycznych, których używanie uznane zostało za konieczne. Jednakże ustawodawstwa krajowe będą mogły zezwolić w drodze wyjątku, aby dostarczanie i odnawianie protez i aparatów ortopedycznych było zastąpione przez udzielenie ofierze wypadku odszkodowania dodatkowego, które będzie określane przy ustalaniu lub rewizji wysokości odszkodowania i będzie odpowiadało przypuszczalnym kosztom dostarczania i odnawiania tych protez i aparatów.

Les victimes d'accidents du travail auront droit à la fourniture et au renouvellement normal, par l'employeur ou l'assureur, des appareils de prothèse et d'orthopédie dont l'usage sera reconnu nécessaire. Toutefois, les législations nationales pourront admettre à titre exceptionnel le remplacement de la fourniture et du renouvellement des appareils par l'attribution à la victime de l'accident d'une indemnité supplémentaire déterminée au moment de la fixation ou de la revision du montant de la réparation et représentant le coût probable de la fourniture et du renouvellement de ces appareils.

Injured workmen shall be entitled to the supply and normal renewal, by the employer or insurer, of such artificial limbs and surgical appliances as are recognised to be necessary: provided that national laws or regulations may allow in exceptional circumstances the supply and renewal of such artificial limbs and appliances to be replaced by the award to the injured workman of a sum representing the probable cost of the supply and renewal of such appliances, this sum to be decided at the time when the amount of compensation is settled or revised.

Co się tyczy odnawiania protez i aparatów, ustawodawstwa krajowe określą środki kontroli konieczne, bądź aby uniknąć nadużyć, bądź w celu zapewnienia odpowiedniego zużytkowania dodatkowych odszkodowań.

Les législations nationales prévoieront, en ce qui concerne le renouvellement des appareils, les mesures de contrôle nécessaires, soit pour éviter les abus, soit pour garantir l'affectation des indemnités supplémentaires.

National laws or regulations shall provide for such supervisory measures as are necessary, either to prevent abuses in connection with the renewal of appliances, or to ensure that the additional compensation is utilised for this purpose.

Dokumenty ratyfikacyjne niniejszej konwencji, zgodnie z warunkami przewidzianymi w Części XIII Traktatu Wersalskiego i odpowiednich Częściach innych Traktatów Pokoju, będą przesyłane Sekretarzowi Generalnemu Ligi Narodów i przez niego rejestrowane.

Les ratifications officielles de la présente Convention dans les conditions prévues à la Partie XIII du Traité de Versailles et aux Parties correspondantes des autres Traités de Paix seront communiquées au Secrétariat général de la Société des Nations et par lui enregistrées.

The formal ratifications of this Convention under the conditions set forth in Part XIII of the Treaty of Versailles and in the corresponding Parts of the other Treaties of Peace shall be communicated to the Secretary-General of the League of Nations for registration.

Niniejsza konwencja wejdzie w życie, gdy dokumenty ratyfikacyjne dwóch Członków Międzynarodowej Organizacji Pracy zostaną zarejestrowane przez Sekretarza Generalnego.

La présente Convention entrera en vigueur dès que les ratifications de deux Membres de l'Organisation internationale du Travail auront été enregistrées par le Secrétaire général.

This Convention shall come into force at the date on which the ratifications of two Members of the International Labour Organisation have been registered by the Secretary-General.

Obowiązywać ona będzie tylko tych Członków, których dokumenty ratyfikacyjne zostały zarejestrowane w Sekretariacie.

Elle ne liera que les Membres dont la ratification aura été enregistrée au Secrétariat.

It shall be binding only upon those Members whose ratifications have been registered with the Secretariat.

Następnie konwencja ta wejdzie w życie dla każdego Członka od daty zarejestrowania jego dokumentu ratyfikacyjnego w Sekretariacie.

Par la suite, cette Convention entrera en vigueur pour chaque Membre à la date où sa ratification aura été enregistrée au Secrétariat.

Thereafter, the Convention shall come into force for any Member at the date on which its ratification has been registered with the Secretariat.

Z chwilą, gdy ratyfikacje dwóch Członków Międzynarodowej Organizacji Pracy zostaną zarejestrowane w Sekretariacie, Sekretarz Generalny Ligi Narodów poda ten fakt do wiadomości wszystkich Członków Międzynarodowej Organizacji Pracy. Zawiadomi on również Członków o zarejestrowaniu ratyfikacyj, przesłanych mu później przez innych Członków Organizacji.

Aussitôt que les ratifications de deux Membres de l'Organisation internationale du Travail auront été enregistrées au Secrétariat, le Secrétaire général de la Société des Nations notifiera ce fait à tous les Membres de l'Organisation internationale du Travail. Il leur notifiera également l'enregistrement des ratifications qui lui seront ultérieurement communiquées par tous autres Membres de l'Organisation.

As soon as the ratifications of two Members of the International Labour Organisation have been registered with the Secretariat, the Secretary - General of the League of Nations shall so notify all the Members of the International Labour Organisation. He shall likewise notify them of the registration of ratifications which may be communicated subsequently by other Members of the Organisation.

Każdy Członek, ratyfikujący niniejszą konwencję, zobowiązuje się, z zastrzeżeniem postanowień artykułu 13, do stosowania postanowień artykułów 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 i 11 najpóźniej od dnia 1 stycznia 1927 r. i do powzięcia środków,

Sous réserve des dispositions de l'article 13, tout Membre qui ratifie la présente Convention s'engage à appliquer les dispositions des articles 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 et 11 au plus tard le 1er janvier 1927 et à prendre telles mesures qui seront nécessaires

Subject to the provisions of Article 13, each Member which ratifies this Convention agrees to bring the provisions of Articles 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 and 11 into operation not later than 1 January 1927 and to take such action as may be necessary

Każdy Członek Międzynarodowej Organizacji Pracy, ratyfikujący niniejszą konwencję, zobowiązuje się do stosowania jej w swoich koloniach, posiadłościach i protektoratach, zgodnie z postanowieniami artykułu 421 Traktatu Wersalskiego i odpowiednich artykułów innych Traktatów Pokoju.

Tout Membre de l'Organisation internationale du Travail qui ratifie là présente Convention s'engage à l'appliquer à ses colonies, possessions ou protectorats, conformément aux dispositions de l'article 421 du Traité de Versailles et des articles correspondants des autres Traités de Paix.

Each Member of the International Labour Organisation which ratifies this Convention engages to apply it to its colonies, possessions and protectorates, in accordance with the provisions of Article 421 of the Treaty of Versailles and of the corresponding Articles of the other Treaties of Peace.

Każdy Członek, który ratyfikował niniejszą konwencję, może po upływie okresu pięcioletniego od daty pierwotnego wejścia jej w życie, wypowiedzieć ją aktem, który prześle do zarejestrowania Sekretarzowi Generalnemu Ligi Narodów. Wypowiedzenie to nabiera mocy dopiero po upływie roku od daty zarejestrowania go w Sekretariacie.

Tout Membre ayant ratifié là présente Convention peut la dénoncer, à l'expiration d'une période de cinq années après la date de la mise en vigueur initiale de la Convention, par un acte communiqué au Secrétaire général de la Société des Nations et par lui enregistré. La dénonciation né prendra effet qu'une année après avoir été enregistrée au Secrétariat.

A Member which has ratified this Convention may denounce it after the expiration of five years from the date on which the Convention first comes into force, by an act communicated to the Secretary - General of the League of Nations for registration. Such denunciation shall not take effect until one year after the date on which it is registered with the Secretariat.

Co najmniej raz na lat dziesięć Rada Administracyjna Międzynarodowego Biura Pracy winna złożyć Konferencji Ogólnej sprawozdanie o stosowaniu niniejszej konwencji i postanowić, czy należy umieścić na porządku obrad Konferencji sprawę rewizji lub zmiany rzeczonej konwencji.

Le Conseil d'administration du Bureau International du Travail devra, au mûtes; une fois tous les dix ans, présenter à la Conférence générale un rapport sur l'application de la présente Convention et décidera s'il y a Heu d'inscrire à l'ordre du jour de la Conférence la question de la revision ou de la modification de la dite Convention.

At least once in ten years, the Governing Body of the International Labour Office shall present to the General Conference a report on the working of this Convention and shall consider the desirability of placing on the agenda of the Conference the question of its revision or modification.

The French and English texts of this Convention shall both be authentic.

Tekst powyższy jest tekstem autentycznym Projektu Konwencji, należycie przyjętego przez Konferencję Ogólną Międzynarodowej Organizacji Pracy na jej siódmej sesji, która odbyła się w Genewie i została zamknięta dnia 10 czerwca 1925 r.

Le texte qui précède est le texte authentique du Projet de Convention dûment adopté par la Conférence générale de l'Organisation internationale du Travail dans sa septième session qui s'est tenue à Genève et qui a été déclarée close le 10 juin 1925.

The foregoing is the authentic text of the Draft Convention duly adopted by the General Conference of the International Labour Organisation during its Seventh Session which was held at Geneva and declared closed the 10th day of June 1925.
